ARTICLE 1: PARTIES AND DEFINITIONS

These General Terms and Conditions of Sale (GTC) apply between:

Hereinafter referred to as “RODHOUSE”.

The buyer: any person wishing to make a purchase via the RODHOUSE website.

Definitions

  • Consumer: a natural person acting for purposes that do not fall within the scope of their commercial, industrial, craft, professional or agricultural activity (preliminary articles of the French Consumer Code).

  • Professional: a natural or legal person acting for purposes falling within the scope of their professional activity.

  • Buyer: generic term referring indifferently to a Consumer or a Professional, unless otherwise specified.

Any internet user may read these GTC on the website or upon simple request to customer service.

ARTICLE 2: SCOPE

The buyer declares that they are at least eighteen years old, have legal capacity or hold an authorisation enabling them to be bound by these GTC and to place an order on the website.

These GTC aim to define the terms of distance selling, from the placing of the order to payment and delivery. They govern all the steps necessary to conclude the contract and ensure its follow-up between the contracting parties.

The acquisition of goods via the website implies the buyer’s unreserved acceptance of these GTC and the waiver of any right to invoke their own general or specific conditions, except in the case of a prior, express and written derogation.

These GTC take precedence over all other conditions not expressly accepted by RODHOUSE SAS.

RODHOUSE SAS reserves the right to modify these GTC at any time. It is therefore recommended that the buyer consult the GTC on each new visit to the website. The applicable conditions are those in force on the date of the order.

ARTICLE 3: CHARACTERISTICS OF THE GOODS OFFERED

The products offered are those listed in the RODHOUSE SAS online catalogue, available within the limits of available stocks. This availability does not apply to promotional operations, with the exception of sales and clearance events.

Any offer complies with the provisions of Articles L310 et seq. of the French Commercial Code, as well as Decree no. 77‑105/P of 2 September 1977 on price advertising to consumers, as amended by the Decree of 3 December 1987.

Each product comes with:

  • a description provided by the supplier,

  • where applicable, technical documentation accessible to the buyer,

  • and indicative photographs, which endeavour to faithfully represent the product (particularly in terms of colours), without being able to guarantee a perfect likeness.

Products remain the property of RODHOUSE SAS until full payment has been received.

If the buyer wishes to acquire a product to combine with another they already own, they must state this expressly when placing the order. RODHOUSE SAS cannot be held liable for compatibility difficulties that were not foreseeable at the time of the order.

ARTICLE 4: PRICES

The prices of the products offered by RODHOUSE SAS are indicated in euros including all taxes (VAT included), excluding handling and shipping fees. RODHOUSE SAS reserves the right to modify its prices at any time. However, products will be invoiced on the basis of the rates in force on the date the order is validated.

The prices displayed on the site are regularly updated. In the event of a temporary display error, the order summary shown at checkout is the authoritative reference for the applicable amounts.

Conditions for professionals:

No discount will be granted for any early payment.

ARTICLE 5: ORDER

To place an order, the buyer must:

  1. Complete the identification form by providing all required contact details or enter their customer number if they have one.

  2. Complete the online order form by indicating the references of all chosen products.

  3. Validate and check their order.

  4. Make payment in accordance with the agreed terms and conditions.

  5. Confirm their order and payment.

Confirmation of the order constitutes unreserved acceptance of these GTC, acknowledgement of having read them, and a waiver of the right to invoke any proprietary or competing purchasing conditions.

All information provided, as well as the recorded confirmation, constitute proof of the transaction and are equivalent to an electronic signature.

RODHOUSE SAS sends the buyer an order confirmation email, enabling them to modify the order up to the date of dispatch of the items and to correct any data entry errors.

RODHOUSE SAS cannot be held liable for data entry errors or their consequences; the redelivery costs associated with a correction are borne by the buyer.

Note: The earlier reference stating that “any order must correspond to the normal needs of a household” applies only to orders placed by Consumers. Orders placed by Professionals may be subject to quantity limits and/or specific conditions communicated on a case-by-case basis.

ARTICLE 6: PAYMENT METHODS

The price is payable upon order. Payments may be made by:

Credit card:

  • All cards must be internationally valid if issued outside France.

  • Secure payment via Shopify Payments (SSL), ensuring encryption of bank details.

  • The buyer’s account is only debited at the time of dispatch of the available products and for the corresponding amount.

Cheque:

  • In euros, drawn on a bank domiciled in France or Monaco.

  • Made payable to RODHOUSE SAS and sent to:

  • Cashed upon receipt.

PayPal:

  • Payment possible via a PayPal account; the transaction is secured according to the provider’s conditions.

In the event of late payment, RODHOUSE SAS reserves the right to claim late payment interest calculated at the statutory rate in force from the date of formal notice.

ARTICLE 7: PAYMENT SECURITY

To ensure payment security, RODHOUSE SAS uses the secure payment service Shopify Payments, incorporating the SSL (Secure Socket Layer) standard. Confidential data — 16-digit card number, expiry date, security code — are transmitted directly in encrypted form and do not pass through RODHOUSE SAS servers.

The online provision of bank details and the final validation of the order constitute proof of the order in its entirety and will be equivalent to an electronic signature and express acceptance of all transactions carried out on the website.

ARTICLE 8: CUSTOMS DUTIES

Any order placed on the website and delivered outside France may be subject to taxes and customs duties imposed when the parcel reaches its destination. These potential duties and taxes are the exclusive responsibility of the buyer.

RODHOUSE SAS is not required to verify, collect or inform the buyer of customs duties and taxes applicable in the country of destination. The buyer is advised to enquire in advance with the competent customs or tax authorities in their country as to the amount and terms of payment.

ARTICLE 9: AVAILABILITY

The product offers and prices proposed by RODHOUSE SAS are valid for as long as they appear on the website and within the limits of available stocks, outside of promotional or price reduction periods. For products not stocked in RODHOUSE SAS warehouses, offers remain valid subject to availability from suppliers.

Information on availability is provided when placing the order, based on information transmitted by suppliers. Any errors or changes that may occur remain the responsibility of the suppliers.

In accordance with Article L121‑20‑3 of the French Consumer Code, in the event that a product becomes unavailable after the order has been placed, the buyer is informed by email as soon as the information is received from the supplier. The relevant order will then be automatically cancelled and, if the buyer’s bank account has been debited, an immediate refund of the amount actually paid will be made.

For payments by cheque, the refund will be made, at RODHOUSE SAS’s discretion, by bank credit or by cheque, no later than thirty days after the date of encashment of the cheque.

ARTICLE 10: DELIVERY

Deliveries are made to the address indicated when placing the order, accompanied by a detailed invoice stating the amount of value added tax (VAT). Shipping costs are determined based on the delivery address, mode of transport, number of items, weight and total order amount.

RODHOUSE SAS delivers orders to several countries in the European Union (Germany, Austria, Belgium, Cyprus, Denmark, Spain excluding the Canary Islands/Ceuta/Melilla, Estonia, Finland, France excluding overseas territories, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Czech Republic, United Kingdom excluding the Channel Islands, Slovakia, Slovenia, Sweden, non-exhaustive list). Additional charges may apply depending on the destination. For deliveries outside these areas, please contact us at contact@rodhouse.com to find out about terms and costs of shipment.

RODHOUSE SAS undertakes to inform the buyer, before conclusion of the contract, of the delivery deadline for the goods or the performance deadline for the service. In the event of a delay of more than seven days, the consumer may cancel the order by recorded delivery letter with acknowledgement of receipt and will be refunded the amounts paid within thirty days.

RODHOUSE SAS cannot be held liable for delays or lost parcels attributable to a third party to the transport contract, to the buyer themselves or to a case of force majeure. If you do not receive your parcel within the indicated timeframes, please inform the customer service so that an investigation can be conducted with the carrier (maximum duration: 21 working days). If the parcel is found, it will be reshipped; if it remains untraceable, it will be considered lost and you will be refunded. No resending or refund will take place during the investigation period.

Checking and recording anomalies
Upon receipt of the order, it is strongly recommended to:

  • Check the conformity of the products (quantity, references, condition) in the presence of the delivery person.

  • Record any anomaly or damage on the delivery note in the form of precise and complete handwritten reservations, accompanied by the signature of the recipient.

Managing reservations upon delivery
To preserve your rights and facilitate any recourse against the carrier, it is essential to:

  • Check the products at the time of delivery.

  • Examine the contents of damaged packaging in the presence of the driver.

  • Ask the driver for a document authorising written reservations to be formalised (not possible on electronic signing devices).

  • Formalise precise and complete written reservations regarding the goods.

  • Specify whether the reservations relate exclusively to the packaging; only the packaging will then be compensated.

  • Indicate whether the packaging was opened or re-sealed in the event of missing items.

  • Mention the reference or name of the damaged part(s) and the number of parts concerned.

  • Describe the damage suffered (e.g.: “2 references XXX damaged, broken, with dented side” or “parcel opened and 2 references XXX missing”).

  • In the event of suspicious breaking sounds, open the parcel and formalise precise reservations about the contents.

  • Anticipate any contradictory reservations made by the driver.

  • Send a reasoned protest within 3 clear days (or 7 days for international shipments) to request a judicial expert opinion from the competent commercial court.

Examples of inoperative or unsubstantiated reservations
“Subject to unpacking/inspection”; “Damaged box, crushed parcel”; “Pallet broken or fallen from the lorry”; “Unsaleable goods, damaged goods”; “X items missing” without mention of the packaging being opened or repackaged.

Each delivery is deemed to have been made as soon as the products are made available by the carrier. When the status shows “delivered”, the carrier’s proof is authoritative, unless the buyer provides evidence to the contrary. RODHOUSE SAS reserves the right to refuse any request for refund or resending for non-delivery or loss of parcel.

ARTICLE 11: RIGHT OF WITHDRAWAL (CONSUMERS ONLY) & RETURN PROCEDURES

11.1 Legal right of withdrawal (Consumers)

The Consumer has a period of fourteen (14) days from delivery of their order to return any product to RODHOUSE SAS, without penalty, for exchange or refund.

Procedure:

  • First contact customer service by email (contact@rodhouse.com) or by telephone (non-premium rate call) to obtain a return form with a return number (RMA).

  • Complete and enclose this return form with the item(s) to return.

  • Send the goods at the Consumer’s expense, with the carrier of their choice.

  • Upon receipt of the parcel, RODHOUSE SAS will send a confirmation email and specify the refund terms. The item amount will be refunded within ten working days by cheque, bank transfer or credit card, less any unpaid return shipping costs.

Incomplete, worn, damaged or soiled products will not be taken back.

Exceptions (Order no. 2001‑741 of 23 August 2001 and Article L121‑20‑2 of the French Consumer Code, and subsequent texts):

  • Supply of services the performance of which has begun, with the consumer’s agreement, before the end of the withdrawal period;

  • Goods or services whose price depends on fluctuations in the financial market;

  • Goods made to the consumer’s specifications or clearly personalised, or which by their nature cannot be returned or are liable to deteriorate rapidly;

  • Unsealed audio, video recordings or computer software;

  • Newspapers, periodicals or magazines;

  • Authorised betting or lottery services.

11.2 Professional returns (outside legal warranties)

Purchases made by Professionals are not subject to any right of withdrawal.

11.3 Abusive returns and behaviour

In the event of abusive returns, RODHOUSE SAS reserves the right to refuse any subsequent order.

ARTICLE 12: WARRANTY

All products supplied by RODHOUSE SAS benefit from the legal warranty of conformity and the warranty against hidden defects provided for in Articles 1641 et seq. of the French Civil Code.
In the event of non-conformity or hidden defect of a product, the buyer may choose to have it replaced or refunded.

All complaints, requests for exchange or refund must be sent, within thirty days from the delivery date, by recorded delivery letter with acknowledgement of receipt to:

RODHOUSE SAS always favours an amicable resolution: the buyer may first contact customer service by e-mail at contact@rodhouse.com to find a satisfactory solution.

ARTICLE 12.1: WARRANTY FOR ASSEMBLED RODS

In accordance with Articles L.217‑7 to L.217‑14 of the French Consumer Code and Articles 1641 to 1649 of the French Civil Code, the purchase of an assembled fishing rod is warranted against any conformity defect or hidden defect for a period of two years from the date of purchase.

Warranty exclusions
Normal wear of the product.
Damage resulting from inappropriate use (caught in a car door, stepped on, violent impact, snagging in water or in trees causing overloading, incorrect fighting angles, too heavy lure, too tight drag).
Neglect of maintenance.
Damage caused by the use of unsuitable equipment.
Incidents following modifications made to the rod.

Cause and assessment
Structural defects (compaction defects, porosity) generally cause rapid breakage, often from the first uses. Less than 5% of breakages stem from manufacturing defects; the vast majority are due to inappropriate use or transport.

Coverage conditions
0–6 months: full coverage under warranty if use is appropriate. In the event of accidental breakage (e.g. car door), a commercial gesture of 50% is applied to the price of the broken element.
6–12 months: commercial gesture of 45% on the repurchase price of the broken element, regardless of the reason.
12–24 months: commercial gesture of 40% on the repurchase price of the broken element, regardless of the reason.

Application process
For any coverage, the buyer must send by email to contact@rodhouse.com:

  • Three photos:

    • Wide-angle view showing the rod and its environment (case, accessories).

    • Photo of the rod reference.

    • Close-up of the broken part.

  • The invoice or order number.

  • A precise description of the circumstances and mechanism of the breakage.
    The email exchange serves as a written record for tracking the request.

General provisions
This warranty applies to the original buyer and covers all EU countries.
It does not apply to second-hand sales.
RODHOUSE SAS reserves the right to revise these conditions without notice.
Rods in the Workshop series, assembled and tested in-house, benefit from the same warranty conditions.

ARTICLE 13: LIABILITY

In the context of online sales, RODHOUSE SAS is bound by an obligation of means. Its liability cannot be incurred for any damage resulting from:

  • Use of the internet network (data loss, intrusions, viruses, service interruptions, etc.).

  • Failure to comply with its contractual obligations due to an unforeseen event or force majeure as defined by the case law of the French courts.

  • A stock shortage at a supplier.

RODHOUSE SAS also disclaims liability:

  • For indirect damage resulting from purchases made for professional purposes (loss of business, loss of profits, loss of opportunity, commercial damage, etc.).

  • If the items delivered are not in compliance with the legislation of the delivery country outside France.

RODHOUSE SAS nevertheless undertakes to implement all necessary professional care to provide a quality service and promote customer satisfaction.

ARTICLE 14: INTELLECTUAL PROPERTY

All elements of the RODHOUSE SAS website — whether software (code, scripts), visual (images, logos, graphic designs) or sound (audio content) — are and shall remain the exclusive intellectual property of RODHOUSE SAS.

It is strictly forbidden for any person to reproduce, represent, adapt, modify, extract, exploit or disseminate, even partially, these elements without prior written authorisation from RODHOUSE SAS. Any violation of this prohibition may result in civil and criminal prosecution.

RODHOUSE SAS however authorises, on a non-profit basis, non-commercial, associative or participatory websites and media to use the media (images, texts, videos) available on its website www.rodhouse.com, provided that:

  • This use is not for commercial or advertising purposes.

  • The content is cited in full with a clear and visible reference to the source (“Source: www.rodhouse.com”).

  • Any hyperlink to the RODHOUSE SAS website is easily identifiable and does not mislead as to the identity of the publisher. RODHOUSE SAS reserves the right to request the removal of any authorised link without justification.

ARTICLE 15: PERSONAL DATA

In accordance with French Law no. 78‑17 of 6 January 1978 on data processing, files and individual freedoms, the personal information collected by RODHOUSE SAS may be subject to automated processing declared with the CNIL.

Purpose of processing
Management of orders and customer relations.
Sending commercial and promotional information (with prior consent).
Analysis and improvement of website performance (traffic statistics).

Cookies and trackers
RODHOUSE SAS uses cookies to recognise returning visitors and facilitate navigation.
Functional cookies (necessary for the website to function) and analytical cookies (e.g. Google Analytics) may be deposited.
Data collected via Google Analytics is transmitted and stored under Google’s sole responsibility.
The user can deactivate cookies via their browser settings.

Sharing and recipients
Data may be shared with:

  • Logistics and payment providers (for order fulfilment).

  • Commercial partners, if the user has given consent.

Retention period

  • For the duration necessary for the management of the commercial relationship.

  • In accordance with legal obligations (invoicing, warranty, disputes).

Rights of data subjects
Right of access, rectification, erasure and portability of data.
Right to object and restrict processing.
Right to define post-mortem directives.

ARTICLE 16: ENTIRETY

If one of the clauses of this contract is declared null and void due to a change in legislation, regulations or a court decision, this shall in no way affect the validity, interpretation and execution of the other clauses of these GTC.

ARTICLE 17: DURATION

These GTC apply for the entire duration during which the services and products offered by RODHOUSE SAS on its website www.rodhouse.com are available. They remain in force for as long as the website remains accessible and operational, even for orders in progress.

ARTICLE 18: ARCHIVING AND PROOF

RODHOUSE SAS keeps order forms and invoices on a reliable and durable medium, thereby creating a faithful copy in accordance with Article 1348 of the French Civil Code.

The computerised records of RODHOUSE SAS will be considered as proof of communications, orders, payments and transactions between the parties.

ARTICLE 19: COMMERCIAL LINKS

Commercial and advertising links may be present on the various pages of the RODHOUSE SAS website. These links lead to third-party websites whose content and operation are not under the control of RODHOUSE SAS.

RODHOUSE SAS disclaims all liability regarding the content, availability, functionality or potential damage — whether direct or indirect — suffered by the buyer or any third party when connecting to these external websites.

ARTICLE 20: DISPUTE RESOLUTION

These terms and conditions of sale are governed by French law. In the event of a dispute arising from the interpretation or execution of this contract, the parties undertake to resort primarily to an extrajudicial arbitration procedure, excluding any legal action, according to the following terms:

  • The party wishing to submit the dispute to arbitration must inform the other party by recorded delivery letter with acknowledgement of receipt, specifying the subject of the dispute.

  • Each party has a period of one month from this notification to designate an arbitrator and inform the other party, also by recorded delivery letter with acknowledgement of receipt.

  • If one of the parties does not designate an arbitrator within this period, the other party may refer the matter to the president of the commercial court at the registered office of RODHOUSE SAS (Vannes) to proceed with the appointment of the missing arbitrator.

  • The two designated arbitrators jointly choose a third arbitrator. If no agreement is reached within one month, this third arbitrator is appointed at the request of the more diligent party by the president of the commercial court at the registered office of RODHOUSE SAS.

  • The arbitral award rendered is final, binding and has the force of res judicata between the parties.

If, despite this procedure, the dispute is not resolved or if one of the parties refuses arbitration, the competent courts may be seized. For buyers not residing in France, the French courts remain exclusively competent.

RODHOUSE SAS always favours finding an amicable solution and encourages the parties to make contact as soon as any dispute arises.

ARTICLE 21: CREDITS

Credits are refunded within 15 days.

ARTICLE 22: GIFT CARDS

Gift cards issued by RODHOUSE SAS are valid for one year from their date of issue.

The recipient may partially use the gift card amount for an order and reuse the remaining balance for future purchases, within the validity period.

The purchase of a gift card is not taken into account in the calculation of the total amount spent over the last 365 days, used to determine the customer’s VIP 5, 10 or 15 status.

ARTICLE 23: PROMOTIONAL OFFERS

Promotional offers proposed by RODHOUSE SAS are an integral part of its commercial policy. They are communicated at its sole discretion and apply for a limited period, as indicated when they are published. Even when a promotion is announced as “unlimited”, RODHOUSE SAS reserves the right to modify or limit its duration at any time, without any obligation to give notice.

RODHOUSE SAS is not obliged to inform its customers in advance of upcoming promotions and cannot be required to provide a refund or a commercial discount in the event of cancellation, modification of the duration or conditions of a promotion.

Furthermore, loyalty programmes and the discounts associated with them may have their purpose, terms and application modified at any time, at the discretion of RODHOUSE SAS, without any consideration or compensation being claimable.
