ARTICLE 2: SCOPE OF APPLICATION
The buyer declares that they are at least eighteen years old, have legal capacity, or hold an authorization allowing them to enter into the present general terms and conditions of sale and place an order on the website. These conditions aim to define the terms of distance selling, from the order to payment and delivery. They govern all necessary steps for placing an order and ensure its monitoring between the contracting parties. The parties agree that their relationship will be governed exclusively by this contract. RODHOUSE SAS reserves the right to modify its terms of sale at any time. It is therefore necessary to read these general terms and conditions of sale with each new visit to the website. In this case, the applicable conditions will be those in force on the date of the buyer's order.
ARTICLE 3:
CHARACTERISTICS OF THE PRODUCTS OFFERED The products offered are those listed in the catalog published on the RODHOUSE website. They are available within the limits of available stock. However, this provision does not apply to price promotions and discounts, except for sales and liquidations. Any such offer will comply with the provisions of Articles L310 and following of the Commercial Code, as well as Order 77-105/P of September 2, 1977, regarding price advertising towards consumers, modified by the Order of December 3, 1987. Each product is accompanied by a description provided by the supplier, and the buyer can access the documentation provided by the supplier. The photographs in the catalog are as accurate as possible, but they cannot guarantee a perfect similarity to the offered product, especially regarding colors. The products remain the property of RODHOUSE SAS until full payment of the price by RODHOUSE SAS. If the buyer wishes to purchase a product with the intention of combining it with a product they already possess, they must clearly specify this requirement. RODHOUSE SAS cannot be held responsible for compatibility difficulties that could not have been anticipated.
ARTICLE 4:
PRICES The prices of the products offered by RODHOUSE SAS are indicated in euros, including all taxes, excluding processing and shipping fees. RODHOUSE SAS reserves the right to modify its prices at any time. However, the products will be invoiced based on the rates in effect at the time of order registration. ARTICLE 5:
ORDER Any order placed on the website must correspond to the normal needs of a household. The buyer wishing to purchase a product must: Fill in the identification form by providing all the required contact information or indicate their customer number if they have one; Complete the online order form by indicating the references of all chosen products; Validate the order after verifying it; Make the payment according to the specified terms; Confirm the order and the payment. Confirmation of the order implies acceptance of these terms of sale, acknowledgment of having fully read and understood them, and waiving the buyer's own purchasing conditions or any other conditions. All information provided and the recorded confirmation will constitute proof of the transaction. The confirmation will be considered as a signature and acceptance of the operations carried out. RODHOUSE SAS will send a confirmation of the order by email, allowing the buyer to modify the order until the date of shipment of the items, as well as to correct any input errors. RODHOUSE SAS cannot be held responsible for any input errors and their consequences. In this context, the expenses incurred for reshipment of the order will be borne by the buyer.
ARTICLE 6: PAYMENT TERMS
The price is payable upon ordering. Payments can be made by credit card, check, or through a PayPal account. For credit card payments: Credit cards issued by banks domiciled outside of France must be international credit cards. Payments will be made through the secure Shopify Payments system, which uses SSL (Secure Socket Layer) protocol, ensuring that the transmitted information is encrypted by software and that no third party can access it during transmission over the network. The buyer's account will only be debited at the time of shipment of the available products and for the corresponding amount of those products. For check payments: Payment by bank check is only available for checks in euros issued by a bank domiciled in France or Monaco. The check will be cashed upon receipt. ARTICLE 7: PAYMENT SECURITY
In order to ensure the security of payments, RODHOUSE SAS uses the secure payment service provided by Shopify, called Shopify Payments. This service integrates the SSL (Secure Socket Layer) security standard. Confidential data such as the 16-digit credit card number, expiration date, and CVV code are transmitted encrypted directly and do not pass through the servers of RODHOUSE SAS. The online provision of the credit card number and the final validation of the order constitute proof of the integrity of said order and will result in the amounts committed by the inclusion of the items on the order form becoming due and payable. This validation will serve as a signature and express acceptance of all operations carried out on the website.
ARTICLE 8: CUSTOMS DUTIES
Any order placed on the website and delivered outside of France may be subject to potential customs duties and taxes imposed when the package reaches its destination. These customs duties and possible taxes related to the delivery of an item are the responsibility of the buyer and fall under their responsibility. RODHOUSE SAS is not obligated to verify or inform the buyer of applicable customs duties and taxes. In order to be aware of them, it is recommended that the buyer inquire with the relevant authorities in their country.
ARTICLE 9: AVAILABILITY
The product offers and prices provided by RODHOUSE SAS are valid as long as they are visible on the website, within the limits of available stock (excluding periods of price promotions and discounts). For products that are not stored in RODHOUSE SAS warehouses, the offers are valid subject to availability from RODHOUSE SAS suppliers. Indications regarding the availability of products are provided at the time of placing the order by the buyer. These pieces of information come directly from the suppliers, and as such, errors or modifications may occur. In accordance with Article L121-20-3 of the Consumer Code, in the event of unavailability of a product after placing the order, the buyer will be notified by email upon receipt of information provided by the supplier. The order will be automatically canceled, and if the buyer's bank account has been debited, a refund will be immediately issued corresponding to the amount actually paid. In the case of partial or total unavailability of the order for payments made by check, the refund will be made at the choice of RODHOUSE SAS either by crediting the buyer's bank account or by check, no later than thirty days following the payment of the amounts paid.
ARTICLE 10: DELIVERY
Deliveries are made to the address indicated during the order, accompanied by a detailed invoice indicating the amount of value-added tax (VAT). Shipping costs are determined based on the delivery address, mode of transport, number of items, weight, and total amount of the order. RODHOUSE SAS ensures the delivery of your orders to several countries within the European Union, including: Germany, Austria, Belgium, Cyprus, Denmark, Spain (excluding the Canary Islands, Ceuta, and Melilla), Estonia, Finland, France (excluding overseas territories), Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Czech Republic, United Kingdom (excluding the Channel Islands), Slovakia, Slovenia, and Sweden (non-exhaustive list). Due to higher delivery costs in certain countries within the European Union, additional fees may apply for order delivery. If you reside outside of the mentioned delivery areas and require international delivery, you can contact RODHOUSE SAS via email to obtain the terms and shipping costs. RODHOUSE SAS commits to informing the buyer, before the conclusion of the contract, of the deadline for delivery of the goods or the performance of the service. In the event of a delay of more than seven days, the consumer has the right to cancel the order by registered letter with acknowledgment of receipt. RODHOUSE SAS will then be obligated to reimburse the amounts paid within thirty days. RODHOUSE SAS makes every effort to meet the delivery deadlines mentioned on the website. However, RODHOUSE SAS cannot be held responsible for the consequences of a delivery delay or loss of a package caused by a third party to the transportation contract, the buyer themselves, or due to an unforeseeable and insurmountable event of force majeure. If you do not receive your package within the indicated timeframe, please inform RODHOUSE SAS through the customer service so that an investigation can be conducted with the carrier. This investigation may take up to twenty-one business days from the date of opening. If the product is found during this period, it will be redirected to the originally intended address in the contract. However, if the package is not found at the end of the investigation period, it will be considered lost by the carrier. In this case, you will be reimbursed for the amounts paid. No refunds or reshipments will be made during the investigation period. Upon receipt of the order, it is recommended to check the conformity of the delivered products with the order and indicate, if applicable, on the delivery note, in the form of handwritten reservations accompanied by the signature of the person who received the order, any anomalies concerning them. In the case of payment by check, the order will only be processed upon receipt of the check. Therefore, the applicable timelines in this case are those on the day of check receipt and may differ from those mentioned on the day of placing the order.
ARTICLE 11: RIGHT OF WITHDRAWAL AND RETURNS
Buyers have a withdrawal period of fourteen days from the delivery of their order to return the product to RODHOUSE SAS for exchange or refund without penalty. For any merchandise return, the buyer must first contact RODHOUSE customer service by email or telephone (non-premium rate call) to obtain a return form that will be sent to them by email, including a return number. This form must be completed and sent with the goods to be returned. The buyer may also return the merchandise using their own means. An email will be sent to the buyer to inform them of the receipt of the package and the refund procedures. The buyer will receive their refund by check, bank transfer, or credit card refund. The price of the item will be refunded within 10 business days (return costs are borne by the buyer in accordance with Article L. 121-20 of the Consumer Code). It is important to note that incomplete, worn, damaged, or soiled products will not be accepted for return. In accordance with Ordinance No. 2001-741 of August 23, 2001, and Article L121-20-2 of the Consumer Code, the right of withdrawal does not apply in the following cases:
- Provision of services whose performance has begun, with the consumer's agreement, before the end of the seven-day period;
- Provision of goods or services whose price depends on fluctuations in the financial market rates;
- Supply of goods made to the consumer's specifications or clearly personalized or which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly;
- Supply of audio or video recordings or computer software when they have been unsealed by the consumer;
- Supply of newspapers, periodicals, or magazines;
- Betting or lottery services authorized by law. The buyer will be considered informed, not only of the existence of a right of withdrawal but also of its limitations indicated above or, in cases where this right does not apply, by accepting these general terms and conditions of sale. Return shipping costs are borne by the buyer if the delivered goods are in accordance with the order. The returned item must be unworn and free from any damage. Shipping costs for an insufficiently stamped package will be deducted from the amount to be credited to you. In case of abusive returns or threats towards RODHOUSE staff, RODHOUSE reserves the right to refuse any subsequent orders.
ARTICLE 12: WARRANTY
All products provided by RODHOUSE SAS are covered by the legal warranty provided for in Articles 1641 and following of the Civil Code. In the event of non-conformity of a product sold, the buyer has the option to return it to RODHOUSE SAS, which will take it back, exchange it, or refund it. ARTICLE 12.5: WARRANTY ON BUILT UP RODS
In accordance with the Consumer Code (Art L.217-7 to L,217-14) and the Civil Code (Art 1641 to 1649 of the Civil Code), the purchase of a fishing rod is guaranteed against any defect of conformity or latent defect for a period of 2 years.
Warranty exclusions
- Normal wear and tear
- Damage caused by inappropriate use
- Maintenance negligence
- Damage caused by the use of unsuitable materials
- Incident due to modifications made to the rod.
Reason
A rod with a structural defect will break very quickly, from the very first use. That's why we pay particular attention to breakage within 6 months of purchase. Less than 5% of rod breakages are due to product defects. The vast majority of incidents are due to improper use, transport or storage. Here are a few examples of inappropriate use which are not covered by the warranty:
- Crushing in the car door
- Crushing while walking on it
- Shock in the cane
- Breaking due to a hook on the bottom of the water or in the trees which causes overloading.
- Poor respect of fighting angles
- Braiding too heavy / unsuitable braid or monfilament.
- Brake too tight
Conditions
Rod breakage occurring within the first 6 months of purchase, respecting proper use, is 100% covered under warranty. In the event of accidental breakage during the first 6 months (e.g. car door), the customer is offered a 50% sales incentive to buy back the broken item.
For breakages occurring between 6 and 12 months after the date of purchase, the customer is offered a 40% sales incentive to buy back the broken item, whatever the reason.
For breakages occurring between 12 and 24 months after the date of purchase, the customer is offered a 35% sales incentive to buy back the broken item, whatever the reason.
How do I request warranty coverage?

The exchange between Rodhouse and the customer will be made by e-mail, so as to have a written record.These warranty conditions apply to all European countries and cover the initial purchaser. They do not apply to resale. Rodhouse reserves the right to revise these terms and conditions without prior notice.
ARTICLE 13: LIABILITY
In the context of online sales, RODHOUSE SAS is subject to an obligation of means. Its liability cannot be held for any damage resulting from the use of the Internet, such as data loss, intrusions, viruses, service interruptions, or any other involuntary issue. RODHOUSE SAS declines all liability in the event of non-compliance with its contractual obligations due to a case of force majeure or any other event beyond its control that prevents the proper execution of orders. In the case of purchases made for professional purposes, RODHOUSE SAS will not be liable for indirect damages arising from these general terms and conditions of sale, such as loss of business, loss of profits, loss of opportunity, damages, or expenses that may result from the purchase of products. RODHOUSE SAS declines all liability if the delivered items do not comply with the legislation of the country of delivery other than France. RODHOUSE SAS undertakes to exercise all necessary professional care to provide quality service to its customers. However, the liability of RODHOUSE SAS cannot be engaged in the event of non-compliance with its contractual obligations due to a fortuitous event or a case of force majeure as defined by French court decisions. RODHOUSE SAS will not be liable in the event of delays due to stock shortages from the supplier.
ARTICLE 14: OWNERSHIP RESERVATION
All elements of RODHOUSE SAS's website are and will remain the exclusive intellectual property of RODHOUSE SAS. It is strictly prohibited for any person to reproduce, exploit, distribute, or use, even partially, the elements of the website, whether they are of a software, visual, or auditory nature, without express authorization. Any violation of this prohibition may result in criminal prosecution, unless otherwise explicitly stated. RODHOUSE SAS authorizes non-profit, associative, participatory, etc., websites and media to use the media available on its website www.rodhouse.fr, provided that such use is not for commercial purposes and that the original sources (www.rodhouse.fr) are clearly mentioned. If any clause of this contract is declared null and void due to a change in legislation, regulations, or a court decision, it will in no way affect the validity and compliance of the other clauses of these general terms and conditions of sale.
ARTICLE 17: DURATION
These general terms and conditions apply for the entire duration of the availability of the services offered by RODHOUSE SAS on its website.
ARTICLE 18: ARCHIVING AND PROOF
RODHOUSE SAS will keep purchase orders and invoices on a reliable and durable medium, thus constituting a faithful copy, in accordance with Article 1348 of the Civil Code. RODHOUSE SAS's computerized records will be considered as evidence of communications, orders, payments, and transactions between the parties.
ARTICLE 19: COMMERCIAL LINKS
Commercial links may be present on various pages of RODHOUSE SAS's website. RODHOUSE SAS is not responsible for the content or operation of these sites, as well as any damages or losses of any kind suffered by the buyer when connecting to these sites.
ARTICLE 20: DISPUTE RESOLUTION
These online sales conditions are governed by French law. In the event of a dispute arising from this contract, the parties agree, mutually, to submit the dispute to an arbitration process, thereby excluding any recourse to the courts. The arbitration procedure will be as follows: The party wishing to submit a dispute to arbitration must notify the other party by registered letter, indicating the subject of the dispute; Each party must, within one month, appoint an arbitrator of their choice and notify the other party by registered letter; If a party fails to select its arbitrator within the aforementioned timeframe, the other party may request the president of the commercial court where RODHOUSE SAS is headquartered to make the appointment; In the event of disagreement between the appointed arbitrators, they will choose a third arbitrator. In the absence of an agreement, the third arbitrator will be appointed at the request of the most diligent party by the president of the commercial court in the same location as RODHOUSE SAS's headquarters; The arbitral award will be final and binding on both parties. In the event of a dispute and in the absence of an amicable settlement between the parties, the competent courts will be seized, without prejudice to the possibility of recourse or counterclaim. If the customer is not a resident of France, disputes related to the commercial relationship with RODHOUSE SAS will be subject to the exclusive jurisdiction of the French courts. RODHOUSE SAS emphasizes its commitment to customer satisfaction and will always prioritize amicable solutions from the first contact with the buyer.
ARTICLE 21:
CREDITS Credits will be refunded within 15 days.
ARTICLE 22: GIFT CARDS
Gift cards issued by Rodhouse are valid for 1 year from their date of issue. Customers have the option to partially use the amount of the gift card and reuse the remaining balance on future orders.
